Personal Circumstances

1. Owning a business, a business interest, or shares has a real impact on how you should write your Will and plan your estate.

2.  Ownership of Property: distributing your assets in a certain way can, if eligible ensure you benefit from extra Inheritance tax relief. Also, if you own a property with another/others depending on how you own it will depend on whether you can choose who is to benefit. Further owning as Tenants in Common with some additional planning can have advantages in terms of third party threats such as care fees or bankruptcy

3. Separated but not divorced? Your x-spouse/civil partner will still benefit from your estate if you do not have a Will in place

4. Part of a blended family? Without a Will your step-children will go disinherited and/or leaving everything to your partner in a Will would allow them to disinherit your children, additional planning alongside a Will be needed to ensure this does not happen

5. Do you have children? The only way to appoint Guardians is through a legal document, many believe god parents may automatically be Guardians however, this is not the case. Without the appointment of Guardians it is for social services to decide what is best for your child/ren. Further questions also need to be asked? Can your Guardians afford to raise your children? Should anything happen planning can be put in place to provide additional funds to Guardians only if you passed away before your children turned 18, with no monthly subscription/policy

6. Do you trust your child/ren's spouse or civil partner? Do you fear of their divorce/dissolution? With the correct planning, maximum protection can be provided to ensure the inheritance you leave is protected if they were to divorce/dissolve the civil partnership. Or do you dis-trust your own children with the inheritance you are going to leave? Will they 'blow it up the wall?' You can control the money as you like even when you are gone with the correct planning
